Consent to the Processing of Personal Data

By ticking the relevant checkbox, clicking “I agree”, “Continue”, “Sign up”, “Register”, “Subscribe”, or by otherwise using the software service available at https://strophe.app/ (the “Service”), I, as a data subject and user of the Service (the “User”), freely, specifically, knowingly and unambiguously give this consent (the “Consent”) to the processing of my Personal Data by the company identified below.

This Consent is given in accordance with the Federal Decree-Law No. 45 of 2021 Concerning the Protection of Personal Data of the United Arab Emirates, as amended and supplemented from time to time (the “UAE PDPL”), and is confirmed by electronic means in accordance with the Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services, as applicable.

1. Definitions

Capitalized terms not defined in this Consent have the meanings given to them in the License Agreement and the Privacy Policy published on the Service.

“Personal Data” means any data relating to an identified natural person or a natural person who can be identified directly or indirectly, including by reference to identifiers such as a name, voice, image, identification number, electronic identifier, geographical location or other characteristics.

“Processing” means any operation or set of operations performed on Personal Data, whether or not by automated means, including collection, recording, organization, storage, adaptation, alteration, retrieval, use, disclosure by transmission, transfer, dissemination, alignment, restriction, erasure, destruction, anonymization or any other operation described in the UAE PDPL.

2. Categories of Personal Data covered by this Consent

This Consent applies to the following categories of Personal Data, to the extent such data is provided by me, generated by my use of the Service, or required for the operation of the Service:

• Account and profile data: email address, name or display name, nickname, profile image/avatar, password or authentication identifiers, account settings and subscription status.

• Service usage data: projects, workspace identifiers, prompts, files, messages, requests, generated materials and other user content submitted to or created through the Service, to the extent such information contains Personal Data.

• Technical and device data: IP address, cookie identifiers, HTTP headers, browser and application identifiers, device identifiers, operating system, browser type and version, device type, screen resolution, language settings, referrer URL, access date and time, logs and diagnostic data.

• Activity and analytics data: pages visited, session duration, clicks, mouse movements, feature usage, search or prompt history within the Service, preferences and other interaction information.

• Location data: approximate location derived from IP address or device/browser settings, where applicable.

• Support and communications data: messages, attachments, contact details and other information submitted through support requests, feedback forms, email or other communication channels.

• Payment-related data: billing contact details, transaction identifiers, payment status, subscription plan, invoices or receipts, payment method type, card brand and masked card details (for example, the last four digits), where applicable. Full card credentials are processed by payment service providers and are not stored by the Company except as expressly stated in a separate payment credentials consent.

The Service is not intended to receive special categories of Personal Data or confidential information unless this is expressly required for the User’s lawful use of the Service. I undertake not to submit special categories of Personal Data or third-party Personal Data unless I have a valid legal basis and all required permissions to do so.

3. Purposes of Processing

I consent to the Processing of my Personal Data for the following purposes:

• creating, maintaining and administering my account or workspace;

• providing access to the Service, its content, features, subscription plans and support channels;

• identifying and authenticating me when I use the Service;

• processing my requests, prompts, uploads and other user content in order to generate outputs through AI models, AI model aggregators and related technical infrastructure;

• communicating with me, including sending service notices, security alerts, administrative messages, support responses, billing notices and updates related to the Service;

• organizing payments, subscriptions, renewals, invoices, receipts, refunds and fraud-prevention checks;

• improving, testing, personalizing and developing the Service, including analytics, diagnostics, debugging and service performance measurement;

• protecting the rights, property, security and legitimate interests of the Company, Users and third parties;

• detecting, preventing and investigating misuse, fraud, cyber threats, unauthorized access, violations of the License Agreement or applicable law;

• complying with legal, accounting, tax, regulatory and dispute-resolution obligations applicable to the Company;

• sending marketing communications only where a separate opt-in or another lawful basis applies, and subject to my right to unsubscribe.

4. Legal basis

By providing this Consent, I authorize the Company to process the Personal Data described above for the purposes described in this Consent and in the Privacy Policy. This Consent does not limit the Company’s ability to process Personal Data on other lawful bases available under the UAE PDPL and applicable law, including where processing is necessary for the performance of a contract, compliance with legal obligations, protection of legitimate interests, establishment or defense of legal claims, or protection of the public interest, where applicable.

5. Processing operations and method

The Company may process Personal Data by automated and non-automated means, including by collecting, recording, organizing, structuring, storing, updating, retrieving, using, transmitting, making available to processors, anonymizing, restricting, deleting and destroying Personal Data. The Company shall apply appropriate technical and organizational measures designed to protect Personal Data against unauthorized or unlawful processing, accidental loss, destruction or damage.

6. Processors, service providers and international transfers

I acknowledge and consent that, for the purposes set out above, the Company may disclose or make available my Personal Data to its employees, contractors, affiliates, processors and service providers, including providers of cloud hosting, analytics, email and communication tools, payment processing, fraud prevention, customer support, security monitoring, AI model providers, AI aggregators and other technical infrastructure necessary for operation of the Service.

Such service providers may be located in the United Arab Emirates or in other countries. I acknowledge that Personal Data may be transferred, stored or accessed outside the United Arab Emirates, including in jurisdictions that may have data protection laws different from those in the United Arab Emirates. The Company shall take steps described in the Privacy Policy to ensure that such transfers are made in accordance with applicable law and appropriate contractual, technical or organizational safeguards.

7. Cookies and similar technologies

I consent to the use of cookies and similar technologies that are not strictly necessary for the operation of the Service where I have selected the relevant cookie preferences or otherwise provided consent. Strictly necessary cookies may be used to provide the Service and maintain security. I can manage cookies through the cookie banner, where available, or through my browser settings. Disabling certain cookies may affect the functionality of the Service.

8. Data Subject rights

Subject to the conditions and limitations of the UAE PDPL and applicable law, I may have the right to request access to my Personal Data, correction of inaccurate Personal Data, erasure, restriction of Processing, portability, withdrawal of consent, objection to Processing and objection to decisions based solely on automated processing, including profiling, where applicable.

I may exercise these rights by contacting the Company at hello@strophe.app. The Company may request information reasonably necessary to verify my identity and process the request.

9. Withdrawal of Consent

I may withdraw this Consent at any time by using the account settings available in the Service, where such settings are available, or by sending a request to hello@strophe.app. Withdrawal of Consent does not affect the lawfulness of processing carried out before withdrawal. I understand that withdrawal of Consent may make it impossible for the Company to provide all or part of the Service, maintain my account, process payments or provide support.

10. Retention

Personal Data shall be retained for as long as necessary to achieve the purposes described in this Consent and the Privacy Policy, for the duration of my use of the Service, and for any additional period required or permitted by applicable law, including for accounting, tax, security, audit and dispute-resolution purposes. Upon expiry of the applicable retention period, Personal Data will be deleted, anonymized or otherwise processed in accordance with the Privacy Policy and applicable law.

11. Confirmation of electronic consent

The date and time of this Consent shall be deemed to be the date and time when I tick the relevant checkbox, click “I agree”, “Continue”, “Sign up”, “Register”, “Subscribe”, or perform another affirmative action on the Service indicating my agreement to this Consent. The Company may keep technical records confirming the fact, date, time, interface, IP address, account identifier and other technical details of my consent. Such records are sufficient evidence of my free and informed expression of will, unless proven otherwise.
